Rhode Island Road Rules
Rhode Island Driving Laws 2026: Speed Limits, DUI BAC and Rhode Island DMV Road Rules for the Permit Test
What is the default speed limit in Rhode Island when no sign is posted? Rhode Island sets 25 mph in residential areas and 50 to 65 mph on most highways. The Rhode Island DMV uses the 500/200 Rule for headlight dimming. You must dim headlights when an oncoming vehicle is within 500 feet and when following another vehicle within 200 feet. Rhode Island DUI law sets a 0.08% BAC threshold, while drivers under 21 can face driving-while-impaired consequences beginning at 0.02% BAC; a DUI conviction can also be based on other admissible evidence of impairment. Parking within 8 feet of a fire hydrant is illegal.

1. Rhode Island Speed Limits: 25 MPH Business/Residence, 50 MPH Daytime, 45 MPH Nighttime & School Zone Rules
What is the speed limit in a residential area in Rhode Island, and what happens if no sign is posted? When no special hazard requires a lower speed and no altered limit is posted, these Rhode Island prima facie limits apply:
| Location | Default Speed Limit |
|---|---|
| Business or residence districts | 25 mph |
| Other locations, daytime | 50 mph |
| Other locations, nighttime | 45 mph |
| Highways and interstates | 50 to 65 mph as posted |
| Within 300 feet of school entrances/exits, daytime on school days, when warning signs are posted | 20 mph |
Key test point: Rhode Islands written test specifically covers the 500/200 Rule for headlight dimming, 500 feet for oncoming, 200 feet when following. The 8-foot fire hydrant distance is also tested. And remember: if it is raining or snowing, headlights on. RI law makes this mandatory whenever wipers are in use. For Rhode Island speed limits, daytime runs from a half hour before sunrise to a half hour after sunset. In designated construction work zones, speeding fines are doubled twenty-four hours a day.
2. Rhode Island Right-of-Way: Yield to Vehicle on Right, Pedestrians & Emergency Vehicles
Who has the give, never something you take.right-of-way at a 4-way stop in Rhode Island, and do pedestrians always go first? Right-of-way questions are among the most frequently tested; remember: right-of-way is something you
3. RI Turn Signal Law: Minimum 100 Feet Before Turns; Signal Before Lane Changes
Can you turn right on red in Rhode Island, and how far in advance must you signal a turn? Intersection and turn rules are heavily tested, including the right-turn-on-red rule and exactly how far in advance you must signal.
4. Rhode Island Lane Rules: Drive Right Unless Passing, Solid vs Broken Lines & Center Turn Lanes
When can you use the center turn lane in Rhode Island, and what do solid versus broken yellow lines mean for passing? Lane rules determine where you drive and when you can cross a line, all commonly tested on the knowledge exam.
5. Passing in Rhode Island: Signal Before and After, Blink Headlights at Night to Warn Ahead
When is it illegal to pass another vehicle in Rhode Island, and how close to an intersection can you pass? Passing is one of the most dangerous maneuvers on the road, Rhode Island law sets strict distance and visibility rules:
- Only pass on the left, using the oncoming lane, when it is safe and legal.
- Do not pass to the left within 100 feet of or while traversing an intersection or railroad crossing, or where an obstructed view makes the maneuver unsafe. Look for the No Passing Zone pennant sign.
- The vehicle being passed must not speed up while you are overtaking.
- Return to your lane before coming within 100 feet of oncoming traffic.
- Never pass a stopped school bus with flashing red lights, this applies in both directions on undivided roads.
- You may pass on the right when the vehicle ahead is making or about to make a left turn, or on a one-way roadway wide enough for two or more lines of moving vehicles. Never pass on the right by driving off the pavement or main-traveled portion of the roadway.
6. RI Following Distance: 3-Second Rule & Stay 500 Feet Behind Emergency Vehicles
What is the safe following distance in Rhode Island, and how does weather change it? Rhode Island uses the 3-second rule under normal conditions: pick a fixed object ahead, and when the car in front passes it, you should reach it no sooner than 3 seconds later. Add distance when roads are wet or slippery. When following a motorcycle, keep at least a 4-second space cushion; when following a large truck, stay far enough back for the truck driver to see you in the side mirrors. Rhode Island DMV guidance also says to stay 500 feet behind emergency vehicles.
| Condition | Recommended Following Distance |
|---|---|
| Normal conditions | 3 seconds |
| Rain or wet roads | Increase beyond 3 seconds as conditions require |
| Following a motorcycle | At least 4 seconds |
| Following a large truck | Stay far enough back to remain visible in the truck driver's side mirrors; allow additional space |
| Ice or snow | Increase well beyond 3 seconds as conditions require |
| At night or in fog | Increase beyond 3 seconds when visibility is reduced |
7. RI School Bus Law: Stop Rules, Divided Highway Exception, Following Distance & Penalties
Do you have to stop for a school bus on a divided highway in Rhode Island, and what is the fine for passing one illegally? These are two of the most frequently tested topics on the Rhode Island permit exam.
School Buses
- When a school bus stops with flashing red lights and an extended stop arm, all traffic in both directions must stop on undivided roads.
- On roads with a true median or physical barrier, only traffic behind the bus must stop, oncoming traffic may proceed.
- A center turn lane does not count as a divider. On 4+ lane roads without a raised median or barrier, all directions must stop.
- You must remain stopped until the red lights stop flashing and the stop arm is retracted.
- For a first violation under Rhode Island General Laws § 31-20-12, the penalty may include a fine up to $300 and/or a license suspension up to 30 days. A violation established through a live school-bus camera system carries a civil fine of $250-$500 and/or suspension up to 30 days.
- Do not travel in the same lane behind a school bus at a distance of less than 50 feet.
- Railroad crossings: A school bus carrying a school child must generally stop within 15 to 50 feet of the nearest rail before a grade crossing, subject to Rhode Island's statutory exceptions, including when a police officer or traffic signal directs traffic to proceed and crossings within a business or residence district.
Emergency Vehicles
- When you see or hear an emergency vehicle (police, fire, ambulance) with lights or siren: pull to the right edge of the road and stop. Do not block intersections.
- Move Over Law (Rhode Island): When approaching a covered stationary roadside vehicle, including an emergency vehicle, tow truck, transporter truck, highway maintenance vehicle displaying required lights, roadside assistance vehicle displaying amber lights, or a nonemergency vehicle stopped on the shoulder or breakdown lane, move into a lane away from it when the roadway has at least two lanes in your direction and the lane change can be made safely. If you cannot move over safely, slow to a reduced speed that is safe for traffic conditions until you are completely past the vehicle.
8. Rhode Island DUI and DWI Laws: 0.08% DUI Threshold and Under-21 0.02% Rules
What is the legal BAC limit in Rhode Island for drivers under 21, and can you refuse a chemical test? Rhode Island uses DUI law for driving under the influence and separate driving-while-impaired provisions for drivers under 21.
| Rule | Detail |
|---|---|
| DUI threshold | 0.08% BAC. A DUI conviction may also be based on other admissible evidence that the driver was under the influence to a degree that made safe operation impossible. |
| Drivers under 21 | Ages 18-20: BAC 0.02% to under 0.08% is driving while impaired under § 31-27-2.7. Under age 18: BAC 0.02% to under 0.10% triggers the driving-while-impaired provisions of § 31-27-2.5. |
| CDL holders | 0.04% or greater while operating a commercial motor vehicle |
| Implied consent / first refusal | Operating a motor vehicle in Rhode Island implies consent to authorized chemical testing. A first refusal carries a 6-month to 1-year license suspension, a $200-$500 fine, 10-60 hours of community restitution, a $500 highway-safety assessment, and a $200 chemical-testing-program assessment. |
| First DUI, BAC 0.08% to under 0.10% | Fine $100-$300, 10-60 hours of community restitution and/or up to 1 year imprisonment, and license suspension for 30-180 days. Higher BAC levels and drug-impaired driving carry different or increased penalties. |
| Open container law | A driver may not operate on a public highway with an unsealed alcoholic beverage container in the passenger section of the vehicle. |
| Drugs and impairment evidence | Rhode Island DUI law applies to intoxicating liquor, drugs, toluene, controlled substances, or combinations of them. A BAC below 0.08% does not prevent a DUI conviction when other admissible evidence proves impairment. |
9. RI Seat Belt Law: Under 8 AND Under 57 Inches AND Under 80 Lbs in Child Restraint
Who is responsible for seat belts and child restraints in Rhode Island? Rhode Island requires the driver to ensure occupants are properly restrained, with specific rear-seat and child-restraint requirements for children.
| Rule | Detail |
|---|---|
| Children under 8, under 57 inches and under 80 lbs | Must be properly restrained in a federally approved child restraint system in a rear seating position, unless a statutory front-seat exception applies. |
| Infants and toddlers | Children under age 2 or weighing less than 30 pounds must be in a rear-facing car seat. |
| Child under 8 but at least 57 inches or at least 80 lbs | Must properly wear a safety belt and/or shoulder harness in a rear seating position. |
| Ages 8 to under 18 | Must properly wear a safety belt and/or shoulder harness in any seating position; the vehicle operator must ensure compliance. |
| Adults 18 and older | The operator must ensure adult passengers are properly wearing a safety belt and/or shoulder harness, subject to statutory exceptions. |
| Driver requirement | The motor-vehicle operator must properly wear a safety belt and/or shoulder harness while the vehicle is in operation. |
| Current statutory fines | No child restraint: $100. Seat-belt violation for an operator or passenger: $40 under the current Rhode Island fine schedule. |
10. Rhode Island Parking Rules: 8-Foot Fire Hydrant Distance and Other Required Clearances
How far from a fire hydrant must you park in Rhode Island, and is it legal to park on a bridge? These distance rules are frequently tested and easy to miss if you have not studied the specific numbers. Know where you cannot park:
- Within 8 feet of a fire hydrant
- Within 20 feet of a crosswalk at an intersection
- Within 30 feet on the approach to a flashing beacon, stop sign, or traffic control signal
- Within 50 feet of the nearest rail of a railroad crossing
- Within 20 feet of a fire-station driveway entrance, or on the opposite side of the street within 75 feet when properly sign-posted
- On a sidewalk, in front of a driveway, or on a bridge
- In a no-parking zone or alongside a curb painted yellow or red
- Double parking (alongside a vehicle already parked at the curb)
- Headed downhill: turn wheels toward the curb. Headed uphill with a curb: turn wheels away from curb. Uphill without a curb: turn wheels toward the shoulder.
11. Driving in Rhode Island: Snow Removal Law, Coastal Storms & Narragansett Bay Fog
Are headlights required when it is raining in Rhode Island, and what should you do if your car starts to hydroplane? Rhode Island weather can bring heavy rain, coastal fog, snow, and ice; these rules tell you exactly how to adjust.
- Headlights required in Rhode Island sunset to sunrise, when visibility is less than 500 feet, and anytime wipers are in use. The 500/200 Rule: dim at 500 feet oncoming, 200 feet following.
- In heavy fog, use low beams, high beams reflect off fog and reduce visibility.
- If you start to hydroplane, ease off the gas gently. Do not brake hard or turn sharply.
- In icy conditions, brake gently well in advance. Start slowing earlier than normal. Leave extra following distance.
- If your car goes into a skid, steer in the direction you want the front of the car to go. Do not overcorrect.
- Never use cruise control on wet, icy, or slippery roads.
- Snow and ice removal: Do not drive with snow or ice obstructing your view, or with a significant accumulation on the vehicle that could blow off and obscure another driver's vision. Natural accumulation while driving during adverse weather is excluded.
12. Rhode Island License Suspensions & Habitual Offender Rules
Does Rhode Island use driver-license points for speeding and other moving violations? Rhode Island does not use the numeric driver-license point schedule shown in many states. The DMV may suspend driving privileges based on the driver's record and specified grounds, while the habitual-offender law uses qualifying conviction counts within a three-year period.
| Rule | Consequence |
|---|---|
| DMV suspension authority | The DMV may suspend a license for grounds including traffic offenses committed with such frequency as to show disregard for traffic laws and highway safety, reckless or negligent driving, and offenses requiring suspension or revocation. A suspension under this authority may be for up to 1 year. |
| Habitual offender: major qualifying offenses | 3 or more qualifying major convictions or juvenile findings arising from separate acts within a 3-year period can meet the habitual-offender definition. |
| Habitual offender: other qualifying offenses | 6 or more qualifying separate convictions or juvenile findings within a 3-year period can meet the habitual-offender definition when the offenses satisfy the statutory suspension/revocation criteria. |
| Habitual offender licensing period | After a court habitual-offender order, a Rhode Island license may not be reissued for 1 to 5 years and until driving privileges are restored by court order. |
Proof of insurance: Rhode Island drivers on public roads must maintain motor vehicle liability insurance and carry proof of insurance in the vehicle with the registration. The Rhode Island DMV manual lists a $500 fine for failure to comply.
13. Rhode Island Headlight Law: The 500/200 Rule: Dim at 500 Oncoming, 200 Following
When must you dim your high beams in Rhode Island, and how far away does an oncoming car need to be? Rhode Island law specifies exact distances for dimming, and the 500/200-foot rule is one of the most tested questions on the exam.
| Rule | Detail |
|---|---|
| When to use headlights | From sunset to sunrise, and any time visibility is less than 500 feet due to rain, fog, snow, or dust |
| Wipers = headlights | Rhode Island law: headlights must be on anytime wipers are in use, and whenever you cannot see 500 feet ahead |
| High beams, when to use | On open roads with no oncoming traffic and no vehicle directly ahead; increases visibility up to 500 feet |
| Dim to low beams, oncoming traffic | Switch to low beams when within 500 feet of an oncoming vehicle |
| Dim to low beams, following | Switch to low beams when within 200 feet of a vehicle you are following |
| Low beams in fog | Always use low beams in fog, high beams reflect off fog and reduce your visibility |
| Parking lights only | Not a substitute for headlights, illegal to drive using parking lights only |
Key test point: The 500-foot / 200-foot rule is a classic exam question. Oncoming = 500 feet. Following = 200 feet. Dim accordingly.
14. Night Driving in Rhode Island: 500/200 Rule, Blink to Pass & Snow Removal Law
What does "overdriving your headlights" mean in Rhode Island, and why is it dangerous? Driving at night significantly increases crash risk; these rules cover visibility, speed, and wildlife hazards specific to Rhode Island roads.
| Rule | Detail |
|---|---|
| Night driving on RI roads | Always apply the 500/200 Rule, dim for oncoming at 500 feet, dim when following at 200 feet. At night, blink headlights from low to high and back to warn a driver ahead you intend to pass. |
| Reduce speed at night | Even at the posted limit, reduced visibility means you need more time to react, slow down |
| Increase following distance | Increase your following distance beyond the normal 3-second distance when nighttime visibility is reduced |
| Watch for pedestrians & cyclists | They are much harder to see at night, especially away from lit areas |
| Avoid looking directly at oncoming lights | Look toward the right edge of the road to avoid being blinded by oncoming high beams |
| Wildlife and cyclists in RI | Despite being the smallest state, Rhode Islands rural interior (Scituate Reservoir area, Coventry, western RI) has active deer populations at dawn and dusk. Always be alert for cyclists and pedestrians on Providence streets and coastal routes at night. |
| Keep windshield clean | A dirty windshield causes glare at night and significantly reduces visibility |
15. Rhode Island Cell Phone Law: Handheld Use Prohibited, Hands-Free Exceptions & Under-18 Full Ban
Is it legal to use your phone while driving in Rhode Island, including while stopped at a traffic light? Rhode Island law prohibits using a wireless handset or personal wireless communication device for texting or other purposes while driving, subject to listed exceptions such as hands-free use and mounted navigation.
| Rule | Detail |
|---|---|
| Handheld/device use while driving | A driver may not use a wireless handset or personal wireless communication device for texting or other purposes while driving except for statutory exceptions. Handheld calls while the vehicle is in motion are also prohibited. |
| Hands-free and mounted navigation | Hands-free use is permitted for drivers who are otherwise eligible to use a device. A mounted navigation device or app may be activated, viewed, or deactivated, and the law permits a single swipe or tap to activate or deactivate a device feature. |
| Stopped at a traffic light or in traffic | For the distracted-driving statute, "driving" includes being temporarily stationary because of traffic, a traffic light, or a stop sign. Device use is allowed when the vehicle is safely pulled over and removed from the flow of traffic, subject to the statutory exceptions. |
| Drivers under 18 | A driver under 18 may not use a personal wireless communication device while operating a motor vehicle, including hands-free or speakerphone use, except in an emergency. |
| Under-18 penalties | First conviction: $100. Second: $150. Third or subsequent: $250 and/or loss of license until age 18. |
| General distracted-driving penalties | First conviction under § 31-22-30: $100. Second: $150. Third or subsequent: $250. |
Key test point: Rhode Island's current distracted-driving law is broader than a texting-only ban. A red light does not make ordinary handheld device use lawful; pull over and remove the vehicle from the flow of traffic when you need to use the device outside an allowed exception.
16. Rhode Island Railroad Crossings: Stop 15-50 Feet When Required & Train Rules
How far from the tracks must you stop at a railroad crossing in Rhode Island, and what vehicles must always stop even when no train is coming? Railroad crossing rules are tested on the Rhode Island knowledge exam; know exactly when to stop and how far back.
| Rule | Detail |
|---|---|
| When to stop | Stop when lights are flashing, gates are lowering or down, a train is visible or audible, or a flagman signals you to stop |
| How far back to stop | Within 50 feet but not less than 15 feet from the nearest rail when a stop is required; never stop on the tracks |
| When to proceed | Only after the train has completely passed, lights have stopped flashing, and gates are fully raised |
| Multiple tracks | After one train passes, check for a second train on adjacent tracks before proceeding |
| Never race a train | Trains cannot stop quickly, a freight train at 55 mph takes over a mile to stop. Never try to beat a train. |
| Stalled vehicle on tracks | Get everyone out immediately and move away from the tracks at an angle in the direction the train is coming from |
| Parking near crossings | Do not park within 50 feet of a railroad crossing |
Key test point: Never drive around or under a lowered crossing gate, it is illegal and extremely dangerous. Wait until gates are fully raised and all tracks are clear.
17. Rhode Island Roundabouts: Yield on Entry, Lane Selection & Exit Signaling
Rhode Island has roundabouts throughout the state, including in Providence, Cranston, and along US-1 and RI-4. The DMV tests them. Entering traffic yields to vehicles already circulating inside.
| Rule | Detail |
|---|---|
| Who has right-of-way | Vehicles already inside the roundabout always have right-of-way. Entering drivers must yield. |
| Direction of travel | Always travel counterclockwise (to the right) around the central island |
| Entering a roundabout | Slow down, yield to circulating traffic, and enter when there is a safe gap |
| Lane selection, single lane | Follow the directional signs and road markings for your intended exit |
| Lane selection, multi-lane | Follow posted lane-use signs and pavement markings and choose the correct lane before entering; stay in the selected lane through the roundabout |
| Do not stop inside | Never stop inside a roundabout unless to avoid a collision, keep moving at a slow, steady speed |
| Large vehicles | Trucks and buses may use the mountable apron (raised inner ring) to navigate, give them extra space |
| Pedestrians & cyclists | Yield to pedestrians in crosswalks when entering and exiting. Watch for cyclists who may ride through the roundabout. |
Key test point: The most common wrong answer on roundabout questions is thinking you have right-of-way when entering. You never do, yield to traffic already inside.
