Who Qualifies as a Supervisor for California Permit Holders

A valid California Class C, M1, or M2 license is required. The supervisor must be at least 25 years old and sit in the front passenger seat, close enough to take control. Family members, friends, and driving instructors all qualify if they meet these criteria.

You cannot drive alone with a California instruction permit. A qualified supervisor must sit in the front passenger seat at all times.

Supervisor requirements:

• Parent, guardian, or spouse of any age with a valid California license (if you're under 18)
• Non-family supervisors must be at least 25 years old with a valid California license
• Certified driving instructor (any age)

Your supervisor's California driver's license must be valid and in good standing. Practice hours logged with a supervisor whose license is suspended or invalid will not count toward your required 50 hours.

Moving a vehicle in a driveway or parking lot requires a supervisor present. Operating the vehicle on any property accessible to the public is considered driving under CVC.

Passengers With a California Permit - What the Rules Actually Allow

You can drive with friends and passengers of any age with your supervisor present. The provisional license rule banning passengers under 20 does not apply during the permit phase.

The number of passengers is limited by the number of available, working seatbelts.

Night Driving and Freeways on a California Permit - Required, Not Restricted

California requires minors to practice night driving during the permit phase to fulfill the 10 nighttime hours of the 50-hour supervised driving log. Freeway driving is also allowed. There are no time or road-type restrictions during supervised permit driving.

There is no curfew for permit holders. Night driving is required practice, not restricted.

Night driving hours:

• You must complete at least 10 hours of night driving out of 50 total supervised hours
• No time-of-day restrictions apply during the permit phase

Freeway and location rules:

• You can drive on freeways with your supervisor - freeway practice is important for building confidence before your driving test
• You can drive to school only with a supervisor (most schools won't issue parking permits to permit holders)
• You can drive through a drive-thru with your supervisor - there is no rule requiring the supervisor to place the order

Cell Phone Ban and Zero-Tolerance BAC for California Permit Holders Under 18

Drivers under 18 may not use a cell phone in any manner while driving, including hands-free. Drivers under 21 face zero tolerance BAC at 0.01 percent, far below the 0.08 percent standard limit.

Drivers under 18 cannot use any electronic device while driving, even hands-free.

Cell phone violation penalties:

• First violation: $20 base fine (total around $160 with fees)
• Second offense within 36 months: $50 base fine (total around $280) plus one point on your DMV record

If your supervisor is using their phone while you are driving, they can be ticketed for distracted driving under California's hands-free laws.

Alcohol zero tolerance: Any BAC of 0.01% or higher triggers an automatic one-year license suspension.

Driving Alone on a California Permit: CVC §12500 Penalties and the 30-Day Impound

Driving alone on a California instruction permit is a misdemeanor under CVC 12500. Penalties include fines over $250, vehicle impoundment up to 30 days, and a minimum 6-month delay before the next license application.

Driving alone is treated as driving without a license under CVC §12500.

Penalties include:

• Fines up to $250 for an infraction or up to $1,000 for a misdemeanor
• Possible vehicle impoundment for up to 30 days
• DMV permit suspension for up to 12 months, delaying your behind-the-wheel test
• Insurance denial if you cause an accident while driving illegally, leaving you personally liable
